1. Introduction  

1.1.  (“we”, “us”, or “our”) provides an online platform for short-term rental accommodations and property management services in Canada and the USA.

2.1. “User,” “Guest” or “Customer” refers to any individual accessing or utilizing our services.  

2.2. “Property” refers to the real estate accommodations offered on our Website for short-term rental.  

2.3. “Host” refers to the property owner or entity that offers a Property through our platform.  

2.4. “Reservation” refers to any booking made through the Website for a short-term rental.

3. Eligibility  

3.1. You must be at least 18 years of age or the legal age of majority in your jurisdiction to use the Website or enter into any binding contract.  

3.2. By accessing our Website, you represent that you have the legal authority to enter into these Terms.

4. Account Registration and Security  

4.1. In order to participate in bookings, property management, or other services, you may be required to create an account.  

4.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.  

4.3. You agree to notify us immediately if you suspect any unauthorized use of your account.

5. Use of the Website and Booking Process  

5.1. The Website is intended for personal and business use for short-term rental and property management activities.  

5.2. All information provided on our Website is for informational purposes only. We do not guarantee the accuracy or completeness of any content and reserve the right to correct errors, omissions, or inaccuracies at any time.  

5.3. By making a Reservation, you agree to pay all applicable fees in accordance with our pricing and payment policies, and you consent to receive confirmation via email.

6. Cancellations Policy  

6.1. Cancellation terms may vary depending on the Host’s policies as set out on the individual Property listing.  

6.2. In general, cancellations made within the timeframe specified at the time of booking may incur a fee or forfeiture of a deposit.  

6.3. Refunds, if applicable, will be processed within a reasonable period following cancellation and are subject to any deductions for service fees or administrative charges.  

6.4. In cases of force majeure or unforeseen circumstances, our policy may provide for a full or partial refund at our discretion. Guests are encouraged to review the specific cancellation policy for each Property before booking.

7. No Show Policy  

7.1. A “No Show” occurs when a Guest fails to check in on the agreed date without prior cancellation.  

7.2. In the event of a No Show, the Guest will be charged for the first night’s stay and any non-refundable fees as detailed in the Property listing.  

7.3. If the Guest notifies us after the scheduled check-in time, the No Show policy will apply, and any subsequent cancellation may also be subject to additional fees determined by the Host’s cancellation rules.

8. Payment Terms  

8.1. All payments for Reservations are processed through secure payment gateways.  

8.2. Payment obligations, including applicable taxes and fees, must be settled in the manner outlined during the booking process.  

8.3. In the event of a payment dispute, the resolution process shall be governed by our dispute resolution policies as detailed below.

9. Dispute Resolution  

9.1. Any dispute or claim arising in connection with these Terms or the use of our services will first be attempted to be resolved through good faith negotiations between the parties.  

9.2. If the dispute cannot be resolved informally, the parties agree to arbitrate the claim in accordance with the rules of the applicable arbitration authority in the relevant jurisdiction (Canada or USA), and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction.

10. Liability and Disclaimers  

10.1. The Website is provided “as is” without warranty of any kind. We make no representations or warranties whether express or implied regarding the security, suitability, reliability, availability, timeliness, or accuracy of the Website or any content therein.  

10.2. To the fullest extent permitted by law, HostDora Homes shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or services.  

10.3. Our liability in connection with any Booking is limited to the value of the Reservation.

11.2. By using our Website, you consent to our practices regarding data collection and use, as set forth in our Privacy Policy.

12. User Conduct and Prohibited Activities  

12.1. You agree not to misuse or abuse the Website, including but not limited to interfering or disrupting the services, or attempting to gain unauthorized access.  

12.2. Any provision of false or misleading information, manipulation of booking details, or any fraudulent activity is strictly prohibited and may result in immediate termination of your account and legal action.

13. Intellectual Property  

13.1. All intellectual property rights in and to the Website and its content are owned by or licensed to HostDora Homes.  

13.2. You may not reproduce, distribute, or create derivative works from any of the content without our express written permission.

14. Modifications to the Terms and Services  

14.1. We reserve the right to modify or discontinue any part of the Website or these Terms at any time without prior notice.  

14.2. Changes to the Terms will be effective immediately upon posting, and your continued use of the Website following any changes constitutes your acceptance of the new Terms.

15. Governing Law and Jurisdiction  

15.1. These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Property is located (either Canada or USA, as applicable).  

15.2. You agree to submit to the personal and exclusive jurisdiction of the courts located in the relevant jurisdiction for the resolution of any disputes.
